Amendments to the Government Ordinance no. 6/2016 regarding tax facilities

In this issue:

Government Ordinance no. 6/2020 amending Law no. 227/2015 regarding the Tax Code as well as for regulating tax and budgetary measures

The Ordinance amends, among others, the Government Ordinance no. 6/2016 regarding the provision of tax facilities.

The main amendments to the Government Ordinance no. 6/2019 regarding tax facilities are as follows:

- Beneficiaries of the procedure for restructuring outstanding tax liabilities are no longer subject to the condition of having recorded tax liabilities of at least RON 1 million. Hence, the amount of the tax liabilities is no longer a condition for accessing the restructuring procedure;

- Beneficiaries of the restructuring procedure may be:

  • debtors who lose the repayment rescheduling because their provisioned liquidities do not allow the repayment schedule to carry on;
  • debtors who provided guarantees for the tax liabilities according to the Tax Procedure Code;

- The Notice on the intention for accessing the restructuring procedure may be submitted also between February 1st and March 31st, 2020, while the initial deadline had been October 31st, 2020;

- The request for restructuring may be submitted until July 31st, 2020.
