Tax alert 36 – NATA Orders regarding the individual tax obligations set out in the annual tax return, as well as through individual tax decisions

NATA’s President Order 2906/2018 for approval of the Procedure for granting the tax incentive for the anticipated payment of the amounts representing income tax, individual social security contribution and individual health insurance contribution established by annual tax decision
NATA’s President Order 2937/2018 for the approval of the Methodology for the distribution of the amounts paid by individual taxpayers to the sole account and for the settlement of the tax obligations
NATA’s President Order 2936/2018 for approval of the Nomenclature of tax obligations to be paid to the sole account by individual taxpayers
The NATA Orders mentioned above were published recently, in 27, respectively in 28 November 2018, in the Official Gazette no. 1005 and 1006, regarding clarifications of aspects on annual individual tax obligations, as follows:
Order 2906/2018 approving the Procedure for granting the tax incentive for the anticipated payment of the amounts representing tax obligations established by annual tax decisions, which will grant a 10% reduction, under certain conditions, for:
The annual income tax for income earned by individuals in 2017
The individual social security contribution due by individuals for the period 2016-2017
The individual health insurance contribution due by individuals for the period 2014-2017
The Procedure brings clarifications regarding the latest legislative amendments regarding the issuance of the annual decisions and tax incentives granted by the Government Emergency Ordinance no. 89/2018 regarding certain tax-budgetary measures and amending and completing some normative acts.

The Order 2937/2018 setting the Methodology for the distribution of the amounts paid by individual taxpayers to the sole account and for the settlement of tax liabilities, as follows:
Tax liabilities owed by taxpayers for the income estimated/realized after 1.01.2018 will be paid to the sole account
Tax liabilities owed by individual taxpayers for income earned until 31.12.2017, shall be paid separately, to the existing budget accounts for each source of income
Order 2936/2018 approving the Nomenclature of tax liabilities which are paid to the sole account by individual taxpayers and are related to the annual tax return:
Social security contributions
Health insurance contributions
