Tax alert no. 16 - Free movement for Romanian citizens in Switzerland

In this issue:

Free movement for Romanian citizens in Switzerland

The Federal Council of the Swiss Confederation approved on 15 May 2019 the amendment to the ordinance on the free movement of individuals on Swiss territory.

The Ordinance states that on 31 May 2019, the safeguard clause restricting the free movement for Romanian citizens ceases to apply.

In this context, Romanian citizens will benefit of the same conditions of free movement as the citizens of the other EU Member States. For stays longer than 90 days in Switzerland they will have to either find a job or to prove that they have sufficient living means.

The decision of the Federal Council of the Swiss Confederation was welcomed by the Romanian Ministry of Foreign Affairs through a press release published on the ministry’s website on 15 May 2019 (source: http://www.mae.ro/node/48966#null).

The safeguard clause was first activated on 1 June 2017, and then prolonged for another year on 1 June 2018, thus limiting the right of residence for the Romanian citizens on Swiss territory.
